OUR FIRST APPLICATION APPROVED FOR THE NEW TRADEMARK FAST-TRACK EXAMINATION PROCEDURE FOR E-COMMERCE BUSINESSES

The Thai Trademark Office has introduced the new Fast-Track trademark examination procedure specifically for e-commerce business operators known as the “4 Month Plus+ Fast-Track” with the effectiveness as from 1 January 2026. Recognizing the urgent needs of e-commerce business operators for trademark registrations to support their time-sensitive commercial plans, this new Fast-Track procedure is available for an “e-commerce business operator”, which is broadly defined to cover anyone with business in any industry on the Internet, either individuals or businesses. The examination result for the eligible applications will be known within 4 months.

Our firm has successfully secured our first approval under this new Fast-Track procedure for the overseas beverage container producer, who is expanding their online sale to Thailand with the specific date to launch the Thai website. To meet the short-coming launch date, they urgently need trademark registration, which is a prerequisite for registration of the Thai country code domain name (.co.th). We therefore applied for this 4 Month Plus+ Fast-Track and demonstrated the urgency by submitting the business plan with the specific launch date which is being halted due to the need for domain name registration along with the relevant part of the exclusive distribution agreement with the Thai distributor. Keeping in mind the appropriate scope of protection for effective enforceability, the broadest possible services descriptions in Class 35 were carefully chosen from the Trademark Office’s Guideline in order to meet the requirement of this Fast-Track procedure. This milestone marks our firm’s first success under the new procedure and highlights how strategic preparation, supported by clear evidence of urgency and well-structured specifications, can accelerate protection for brand owners expanding into Thailand.

The implementation of this new fast track option demonstrates the Trademark Office’s attempt in expediting examination and good understanding of the time-driven nature of e-commerce businesses. In view of the delay in examination (especially for applications filed through the Madrid Protocol), it is recommended that applicants explore all possible options for Fast-Track procedures, including not only this 4 Month Plus+ Fast-Track but also the existing two channels of 4 and 6 months.
